Terms for this site and workspace.
These terms cover the website and the client workspace. They are deliberately narrow: the commercial terms of a project live in a signed agreement, and this page does not restate them.

Agreement to these terms
These terms govern your use of tropicaltidesnc.com and the Tropical Tides client workspace. By using the site, you accept them. If you do not, please do not use the site.
Tropical Tides Custom Homes is a design and construction practice based in Southport, North Carolina, holding North Carolina General Contractor License #109520.
What this website is, and is not
This is the most important section on the page. Everything published here is informational. Nothing on this site is an offer, a bid, a quote, a price, a guarantee of availability, or a promise to perform work.
Submitting the project inquiry form does not create a client relationship, reserve a place in our schedule, or commit either of us to anything. It starts a conversation. A working relationship begins only when a written agreement is signed by both parties.
Where that signed agreement and this website disagree, the signed agreement controls. Scope, price, schedule, allowances, change orders, warranty, insurance, and dispute resolution are defined there, not here.
Design targets and performance information
The site describes performance standards we design toward, including FORTIFIED Gold and a sub-1.0 ACH50 airtightness target. We are explicit throughout that these are design targets carried into construction. They are not a representation that any particular home has achieved a given result, and they are not a warranty.
Verified results depend on the specific design, the site, the assemblies actually built, third-party testing, and inspection outcomes. Where a project is shown as a concept study or as active design development, that is what it is. The site does not present design work as a completed build.
Any performance commitment applicable to your project will be stated in your project documents, in writing, with the standard and the method of verification named.
Client workspace accounts
Workspace access is provided by invitation to clients and project participants. Accounts are personal to the individual invited.
- Keep your credentials confidential and do not share your login. If someone else needs access, ask us to invite them.
- Tell us promptly if you believe your account has been accessed without your authorization.
- Do not attempt to access projects, documents, messages, or records belonging to anyone else.
- Do not probe, scan, or test the security of the platform, or attempt to defeat its access controls.
- Do not use automated tools to scrape or bulk-download workspace content.
We may suspend or end access that violates these terms, that appears compromised, or where a project relationship has ended. The workspace is provided alongside the project rather than as a separate subscription service, and we do not guarantee uninterrupted availability.
Material you provide
You keep ownership of the material you supply: surveys, existing plans, photographs, covenants, inspiration images, and the content of your messages. By providing it, you grant us permission to use it for the purpose of performing the work, including sharing it with the design and trade partners who need it.
You are responsible for having the right to give us what you send. Please do not upload copyrighted drawings, photographs, or documents that you are not permitted to share.
We will not publish photographs of your project, name you as a client, or use your project in marketing without your permission.
Our content and intellectual property
The text, photography, renderings, diagrams, articles, page design, and the Tropical Tides name and marks on this site belong to Tropical Tides Custom Homes or are used with permission. You may read, link to, and share the public pages. You may not republish, resell, or present our written material as your own, and you may not use our marks without written permission.
Drawings, specifications, and other design documents prepared for a project are instruments of service. Rights in those documents are addressed in your project agreement, not by this page.
Acceptable use of the site
Please do not use this site to break the law, to interfere with its operation, or to harm other people. That includes attempting to disrupt or overload the service, introducing malicious code, misrepresenting who you are, harvesting personal information, or using the inquiry form to send unsolicited commercial messages.
Third-party links and services
The site links to third-party destinations, including our social media profiles, and relies on third-party infrastructure for hosting, content delivery, and analytics. We do not control those services and are not responsible for their content, availability, or practices. Their own terms and privacy policies apply when you use them.
Disclaimers and limits
The site is provided on an as-is and as-available basis. We work to keep it accurate and current, but we do not warrant that it will be error-free, uninterrupted, or complete, and content may change without notice.
Nothing on this site is legal, engineering, financial, insurance, or code-compliance advice for your specific property. Building codes, flood zone designations, wind exposure classifications, permitting requirements, and insurance implications are site-specific and change over time. Verify anything material with the authority having jurisdiction and with your own professional advisors before relying on it.
To the fullest extent permitted by North Carolina law, our liability arising out of your use of this website is limited. This section limits liability for the website only. It does not limit, waive, or modify any obligation, warranty, or remedy under a signed project agreement, and it does not disclaim liability that cannot be disclaimed by law.
Governing law
These website terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles. Any dispute-resolution procedure that applies to your project is the one stated in your project agreement.
Changes to these terms
We may update these terms as the platform changes. The current version is always posted here with its revision date, and continued use of the site after a change means you accept the updated terms.
